منگل 7 جولائی کو، جنوبی افریقہ کی آئینی عدالت نے ایک تاریخی فیصلہ سنایا جس میں ریفیوجز ایکٹ (Refugees Act) کی بعض دفعات کو غیر آئینی قرار دیا گیا۔ جسٹس اسٹیون میجیڈٹ نے حکم دیا کہ محکمہ داخلہ صرف طریقہ کار کی عدم تعمیل یا تاخیر کی بنیاد پر پناہ کے طلبگاروں کو ریفیوجی حیثیت دینے سے انکار نہیں کر سکتا۔ اس سے قبل، نامزد کردہ داخلی بندرگاہوں اور پانچ روزہ ٹرانزٹ ویزا سے متعلق سخت شرائط کے تحت حکام کو درخواستیں مسترد کرنے کا اختیار حاصل تھا، اگر درخواست گزار مخصوص وقت सीमा پوری کرنے یا "معقول وجہ" فراہم کرنے میں ناکام رہتے۔ یہ فیصلہ اس بات کو یقینی بناتا ہے کہ تمام دعووں کا جائزہ ان کے میرٹ کی بنیاد پر لیا جائے، جس سے کمزور افراد کو نظام سے باہر کیے جانے سے تحفظ ملتا ہے۔ اہم بات یہ ہے کہ یہ فیصلہ ان بچوں کا تحفظ کرتا ہے جنہیں ان کے والدین کی طریقہ کار سے متعلقہ کوتاہیوں کی وجہ سے پہلے ریفیوجی حیثیت سے محروم کر دیا گیا تھا۔ اسکیلابرینی سینٹر (Scalabrini Centre) کی جانب سے شروع کیا گیا اور مختلف بین الاقوامی تنظیموں کے تعاون سے لایا گیا یہ کیس ان نظامی خامیوں کا ازالہ کرتا ہے جنہوں نے 'نان ریفیولمنٹ' (non-refoulement) کے اصول کی خلاف ورزی کی اور پناہ تک منصفانہ رسائی کو روکا۔
