3-year-old immigrant was sexually abused in federal custody, lawsuit alleges 06.04.2026

A 3-year-old immigrant child, separated from her mother after crossing the U.S.-Mexico border on September 16, allegedly endured sexual abuse while in prolonged federal immigration custody. The child was transferred to the Office of Refugee Resettlement (ORR) as an unaccompanied minor. On November 11, a foster parent discovered the abuse, leading to the removal of the alleged perpetrator. The child's father, a legal permanent resident in Chicago, only learned of the abuse when seeking legal recourse to reunite with his daughter, who had been in custody for five months. Attorneys filed a habeas corpus petition on February 18, and the child was released to her father on February 21, two days after the petition.
