A Reuters investigation analyzing thousands of court documents reveals that U.S. federal judges have ruled in over 4,400 cases since October that the Trump administration is unlawfully detaining immigrants. These rulings represent a significant judicial rebuke of the administration's intensified immigration policies, which have led to a 75 percent increase in ICE detainees to approximately 68,000 since January 2025. Despite these judicial pronouncements, the government continues to hold individuals indefinitely, even after courts have declared such practices illegal. The majority of these rulings cite a deviation from a nearly 30-year-old federal law that allows immigrants residing in the U.S. to be released on bond while their immigration cases are pending.
