The Labor Inspection Tribunal (TFL) of Sunafil issued Resolution No. 0720-2026-SUNAFIL/TFL-First Chamber, clarifying that employers may pay their workers via checks, but subject to strict conditions. The authority determined that the mere delivery of the negotiable instrument does not prove compliance with the labor obligation, as a check is a conditional means of payment. To avoid sanctions for very serious infractions, companies must present a bank certificate confirming that the worker actually cashed the amount. Legal experts warn that insufficient funds or the absence of proof of payment invalidates the accreditation of vacation pay or wages. It is recommended to prioritize bank transfers to facilitate inspections and, in the event of using checks, to attach documents demonstrating the impossibility of making electronic deposits.
