The Coca-Cola Company initiated a legal proceeding against Orquesta Amaya Hnos S.R.L. and a third party before Indecopi in Peru, alleging trademark infringement due to the use of graphic elements similar to COCA-COLA. Coca-Cola claimed that the orchestra's use of typography and a wavy stripe in its signage, despite operating in a different sector (music services vs. beverages), could lead to undue association or dilute its well-known brand. Coca-Cola sought a preliminary injunction to immediately halt the use of the disputed signs. However, Indecopi's Commission of Distinctive Signs rejected the request on June 5, 2025, finding insufficient evidence of infringement. This decision was upheld by Indecopi's Intellectual Property Appeals Chamber on January 7, 2026, definitively dismissing the request for an immediate cessation of use, although the main trademark infringement process remains ongoing.
