The Constitutional Court has delivered a landmark judgment declaring the Western Cape provincial government's sale of the Tafelberg property in Sea Point, Cape Town, unlawful. The apex court found that the province violated the principles of co-operative governance by failing to consult or inform the national Minister of Human Settlements before disposing of the strategically located state-owned land. Additionally, the Court ruled that the province incorrectly classified the property as surplus to its requirements, and criticized the public participation process as a "hollow box-ticking exercise" that failed to genuinely consider community views.
