Court dismisses homeowner’s bid to overturn default judgment over luxurious estate levy debt 01.06.2026

The Johannesburg High Court has dismissed an application by homeowner Makgolela Lillian Mokgalakane to overturn a default judgment granted to the Lombardy Home Owners Association. The association had sought over R333,000 for outstanding estate levies. Mokgalakane's attempt to defend the claim failed when her attorneys did not properly file a notice of intention to defend on the Court Online system by the required date of March 7, 2024. Although served on the association's attorneys, the notice was only uploaded on April 5, 2024, weeks after the default judgment was granted on March 14, 2024. The court found the judgment was not erroneously granted and that Mokgalakane failed to demonstrate good cause or a bona fide defence, ordering her to pay the association's legal costs.
