Court of Appeal throws out €10,000 tuna farm fine over flawed evidence 25.06.2026

The Court of Appeal has overturned a €10,000 fine imposed on Mare Blu Tuna Farm Ltd by the Director General of Fisheries and Aquaculture, citing serious procedural flaws and insufficient evidence. The case stemmed from 2024 inspections of three tuna transfer operations, where discrepancies in fish counts allegedly exceeded the legal five per cent tolerance margin. After a review, the company was fined, but the Administrative Review Tribunal annulled the penalty in October 2025, finding that the enforcement notice failed to provide a clear "summary of facts" and depended on poor-quality underwater video footage. The footage was never submitted as evidence, and the official who conducted the counts acknowledged that visibility and fish movement could affect accuracy.
