The Constitutional Court, with ruling number 120, has ruled in favor of the government, establishing that the penalties provided for the crime of death or injury resulting from offenses related to illegal immigration, introduced by the so-called "Cutro Decree" of 2023, are not constitutionally illegal. The decision was made in response to questions raised by the Preliminary Hearing Judge of the Court of Syracuse in a case involving the sea transport of thirty-four migrants. Following a collision with a patrol boat during a rescue operation, three people died and ten others were injured.
