CVS has filed a lawsuit against Tennessee state officials in U.S. District Court in Nashville, seeking to block a new law that prohibits companies from owning both pharmacy benefit managers (PBMs) and retail pharmacies. The pharmacy giant argues that the legislation, set to take effect on July 1, 2028, would necessitate the closure of all 136 of its Tennessee locations, impacting over 2,000 employees and 1.5 million patients. CVS, which owns PBM CVS Caremark, contends the law is unconstitutional and creates conflicts of interest, restricting patient access to medications and undermining fair competition.
