The Department of Homeland Security (DHS) and Acting Assistant Secretary Lauren Bis sharply criticized Democratic Governor Abigail Spanberger and Fairfax County officials, labeling the situation a "Sanctuary Calamity" and accusing them of releasing a "child rapist" and "sicko" back into the community. DHS stated Garcia, who entered the U.S. illegally in 2023 and had a final removal order issued in February 2025, was released and appeared in court on his own. Spanberger's office countered that she prioritizes prosecuting violent criminals and that state agencies cooperate with federal partners, while Fairfax County prosecutors emphasized they were actively prosecuting the case and that ICE made the arrest.
