Estranged husband loses appeal after seeking ownership of Suzuki Jimny he had gifted his wife 08.06.2026

The Western Cape High Court has upheld a lower court's decision, dismissing an estranged husband's appeal to regain ownership of a Suzuki Jimny he gifted his wife. The dispute stemmed from a December 2021 agreement where the husband gifted the vehicle, financed by his wife through MFC Nedbank, with him covering repayments. The agreement stipulated ownership would revert to him if the wife separated from him before the finance was settled. After the husband refinanced the vehicle through Investec in August 2023, settling the Nedbank debt, the marriage deteriorated, leading to the wife obtaining a protection order. The husband argued her temporary departure from the marital home triggered the ownership clause, but the court found no proof of separation in the agreement's context and that her departure was due to safety concerns and legal advice.
