Hearsay evidence sees man acquitted of driving without licence and insurance 04.06.2026

Keith Micallef was acquitted of driving without a licence and insurance on Thursday after Magistrate Nadia Helena Vella found the prosecution's evidence to be conflicting and legally insufficient. Micallef faced charges including driving without a valid licence, without insurance, and tampering with a licence disc. While Micallef admitted to tampering with the licence disc, the defence contested the driving offences. The prosecution presented affidavits from Transport Malta (TM) officials, but the defence successfully argued that the sole eyewitness stated the vehicle was parked. Furthermore, claims made by another official, based on a verbal report from the first, were deemed inadmissible hearsay. Consequently, Micallef was acquitted of the driving charges. For the tampered licence disc, to which he pleaded guilty, Micallef received a €500 fine, payable in instalments.
