Heatwaves at work: no thresholds despite ITM inspections 07.07.2026

Minister of Labor Marc Spautz has specified that Luxembourg will not impose legal temperature thresholds to trigger employer obligations, unlike France, Belgium, or Spain. Responding to a question from MP Marc Baum, the government maintains that current risk assessments already allow for the adaptation of working conditions. Although the Labor and Mines Inspectorate (ITM) recommends a temperature of 26°C in premises, this figure has no binding legal value. The Chamber of Employees contests this approach, calling for strict exposure limits based on the WBGT index. Meanwhile, the ITM is intensifying its inspections, increasing from three in 2023 to 46 by the beginning of 2026, with several construction site shutdowns ordered. Finally, the unemployment scheme for inclement weather remains very limited, primarily restricted to the construction sector.
