High Court acquits man in 116kg khat trafficking case 03.06.2026

The High Court of Tanzania, Moshi Registry, acquitted Nestory Machibya on Friday, May 29, 2026, in Economic Sabotage Case No 18604/2024. Machibya had been charged with trafficking 116.69 kilogrammes of khat, a narcotic drug, which was allegedly discovered on July 6, 2023, in Rikweni Village, Same District, Kilimanjaro Region. Justice Safina Simfukwe ruled that the prosecution failed to prove its case beyond a reasonable doubt, citing significant legal defects in the charge sheet that hindered Machibya's ability to prepare a fair defence. The court also identified procedural flaws in the search, seizure, and destruction of the alleged khat, ultimately leading to Machibya's acquittal due to insufficient evidence of possession or control.
