IMF struck out of Kenya's Sh7 trillion 'Odious debt' case, granted immunity 25.06.2026

The International Monetary Fund (IMF) has been removed from a landmark High Court petition that challenges the legality of Kenya’s Sh7 trillion public debt, after a three-judge bench ruled that the global lender enjoys immunity from legal proceedings in Kenyan courts. The ruling, delivered on June 25, 2026, by Justices Francis Gikonyo, Moses Ado, and Roselyne Aburili, allowed an application filed by the IMF seeking to be struck out of the case. The IMF argued that it is protected by international treaties and Kenyan law, which grant it immunity from such legal actions.
