Judge nixes latest policy requiring 7 days' notice for Congress members to visit ICE facilities 02.03.2026

Yahoo

U.S. District Judge Jia Cobb in Washington has temporarily suspended a Trump administration policy mandating a seven-day notice for congressional members to visit immigration detention facilities. The judge ruled that a group of Democratic lawmakers is likely to prove the policy illegal, exceeding government authority, as no concrete safety issues from unannounced visits were cited. This marks the second time Cobb has blocked such a requirement, following a December ruling against a similar policy. The latest version was reinstated by Homeland Security Secretary Kristi Noem shortly after an ICE officer fatally shot a U.S. citizen, leading to three Democratic representatives being denied entry to a facility near Minneapolis. The court found it highly probable that restricted funds were used to enforce the policy, which potentially violates a law barring the use of general funds to impede congressional oversight.
