KPK to assess compatibility of state secretary and mayor functions in the Jaklin case 07.07.2026

The Commission for the Prevention of Corruption (KPK) will assess the case regarding the compatibility of the functions of State Secretary at the Ministry of Infrastructure and Energy and the non-professional mayor of the Municipality of Velika Polana, held by Damijan Jaklin. In its 2023 opinion, the KPK concluded that state secretaries, as professional officials, may not hold functions in other public bodies, which include municipalities. NSi member Jaklin expressed disagreement regarding the legality of this decision during the proceedings, as he had obtained a legal opinion prior to his appointment that permitted him to hold both functions. Experts warn of a conflict of interest dilemma, as access to state information could provide an advantage to a specific municipality. Based on Article 27 of the Integrity and Prevention of Corruption Act, the KPK will assess whether the position of State Secretary is incompatible with serving as a mayor.
