Lawsuit: DHS wants “unlimited subpoena authority” to unmask ICE critics 13.01.2026

The Department of Homeland Security (DHS) is engaged in a legal battle to unmask the owner of MontCo Community Watch's social media accounts, identified as John Doe, who has been posting about Immigration and Customs Enforcement (ICE) activities in Pennsylvania. Doe alleges that the DHS's summons to Meta for subscriber information infringes upon his First Amendment rights to criticize government agencies anonymously and that the DHS is attempting to expand its subpoena authority beyond its legal scope by misinterpreting import/export regulations. The DHS counters that the community watch group's posts, which allegedly include agents' faces and license plates, constitute threats that impede their duties, and that a statute regulating imports and exports empowers them to investigate such alleged threats. A US district judge is set to hear arguments on Wednesday to determine if Doe's right to anonymity outweighs the DHS's claim of investigating serious threats to agent safety.
