TotalEnergies faces a landmark trial in Paris on February 19-20, 2026, initiated by NGOs and the City of Paris, alleging a failure to uphold its environmental vigilance duty by not adequately addressing climate change. The core legal dispute centers on whether the 2017 vigilance law, which mandates companies to identify and prevent risks to human rights and the environment throughout their supply chains, extends to global phenomena like climate change or is limited to local impacts. The Paris public prosecutor's office has sided with TotalEnergies, arguing that a comprehensive climate protection requirement is not feasible under the law, a stance that contradicts the law's rapporteur, Dominique Potier, who believes climate inaction's impact on human life falls within the vigilance duty. The plaintiffs seek the cessation of new hydrocarbon projects and significant production cuts aligned with the 1.5-degree warming target.
