Madeleine McCann prime suspect may not be extradited to UK to face trial due to Brexit, legal experts say 06.05.2026

Brexit has created a significant legal barrier to extraditing Christian Brueckner, the German prime suspect in Madeleine McCann's 2007 disappearance, to the UK for trial. German constitutional law, specifically Article 16, forbids extraditing citizens to non-EU countries, a position upheld by the post-Brexit EU-UK Trade and Cooperation Agreement. Legal experts, including former extradition officials, assert that Germany is highly unlikely to surrender Brueckner, citing past refusals based on prison conditions and fair trial concerns. Pre-Brexit, the European Arrest Warrant enabled streamlined extradition, but now the process requires Crown Prosecution Service approval, faces increased judicial scrutiny, and involves complex documentation. The only conceivable scenario for UK extradition is if Brueckner voluntarily leaves Germany, which experts deem practically impossible.
