Man released from prison after court finds State blundered R2.9 million theft case 03.06.2026

The Mpumalanga High Court has overturned the conviction and seven-year prison sentence of Jacob Zenezele Mncwango, who was accused of misappropriating R2.95 million intended for community development. The court found that crucial banking evidence used to convict Mncwango in January 2023 was inadmissible because the supporting affidavit was fatally defective, failing to meet legal requirements. This rendered the documentary evidence as hearsay, insufficient to prove Mncwango's personal involvement in the theft and money laundering from the Endloveni Community Project Association funds, which were instead paid into Sadia Enterprises Trading CC and subsequently JM Mncwango Trading CC. The court also noted procedural irregularities in the original trial.
