A mass claim against the Dutch Central Judicial Collection Agency (CJIB) concerning automatic increases on penalty fines is advancing, with 6,500 individuals registering for compensation. The core of the claim questions whether these increases, which can escalate to 50% after eight weeks and an additional 100% after twelve weeks, constitute administrative costs or criminal sanctions. Jurist Brahim de Jong, a proponent of the claim, argues that these escalating penalties violate the proportionality principle, asserting that if they are considered a punishment, there should be an avenue for appeal, which is currently absent. The CJIB has introduced a policy allowing for waivers in cases of force majeure or disproportionate hardship, though the vagueness of these terms is noted.
