Medical Council says doctors have no legal obligation to report patient crimes 09.04.2026

The Medical Council of Malta has issued a circular clarifying that doctors and dentists are not legally obligated to report crimes disclosed by their patients, emphasizing the paramount importance of patient confidentiality. This directive follows recent court cases in Malta where women faced prosecution for abortion after being reported by medical professionals. The council reiterated that patient privacy is a fundamental duty outlined in the profession's code of ethics, and while doctors generally have discretion in reporting patient-disclosed crimes, prioritizing patient care, exceptions exist. Professionals are mandated to report cases involving minors or suspected violence, including domestic abuse, to the relevant authorities, such as the police's Domestic Violence Unit or child protection services. Prime Minister Robert Abela has previously stated no intention to change abortion laws but suggested leniency in sentencing for women facing effective prison terms.
