While BJP decides...: Nitish has quit Bihar legislature, here's why he stays CM 30.03.2026

Nitish Kumar has resigned as a Member of the Legislative Council (MLC) in Bihar, a constitutional requirement following his election to the Rajya Sabha on March 16. Despite this resignation, he can legally continue as Chief Minister for up to six months without being a member of the state legislature, as per Article 164(4) of the Constitution. This move allows him to remain CM while preparing for his Rajya Sabha oath on April 10. The dominant partner in Bihar's ruling coalition, the BJP, is yet to finalize its candidate for the Chief Minister's post, a position it is expected to hold for the first time after the NDA's landslide victory in the 2025 assembly elections. Potential successors for the CM role are being discussed, including Deputy CM Samrat Choudhary, Union Minister Nityanand Rai, and Bihar Minister Dilip Kumar Jaiswal.
