Petition Filed Against Parliament Over Kenyatta Benefits Review 05.05.2026

Nairobi-based advocate Shadrack Wambui has filed an urgent court petition seeking to halt a parliamentary process that could review and alter the retirement benefits of former President Uhuru Kenyatta. The petition names the Senate of Kenya, National Assembly, and Office of the Attorney General as respondents, arguing that a motion linked to Kiprotich Cherargei under the Presidential Retirement Benefits Act is unconstitutional and threatens vested rights. Wambui contends that such a review risks violating fundamental rights, including property, fair administrative action, and a fair hearing, and warns Parliament lacks authority to unilaterally vary accrued benefits. He is seeking immediate court orders to preserve the status quo and prevent an unconstitutional process, which is expected to ignite debate over parliamentary limits and the protection of former presidents' entitlements under Kenyan law.
