PRIME Micro-lender bosses face prosecution over ex-employee image use 19.04.2026

The Office of the Data Protection Commissioner (ODPC) in Kenya has recommended the prosecution of directors at LOLC Micro Finance Bank for allegedly publishing a former employee's images on social media and in public notices without his consent. The micro-lender failed to respond to a formal complaint filed by Peter Macharia Waithira, who had resigned on July 28, 2025. Despite his resignation, the bank posted notices stating he was no longer associated with the institution and warned the public against transacting with him, including using his images on Facebook. Data Protection Commissioner Immaculate Kassait stated that this constitutes an obstruction of her office's powers, a violation of Section 61(b) of the Act. The bank has 14 days to remove the images.
