On Friday, US District Judge Timothy J. Kelly dismissed the seditious conspiracy cases against four Proud Boys members—Ethan Nordean, Joseph Biggs, Zachary Rehl, and Dominic Pezzola—who were involved in the January 6, 2021, attack on the US Capitol. The dismissal, granted with prejudice, followed an executive order by President Donald Trump on January 20, 2025, that pardoned most defendants and required the Department of Justice to seek dismissal of ongoing cases. Judge Kelly, a Trump appointee, made clear that his decision was rooted in the separation of powers, not the merits of the case, and noted that the defendants had been "convicted of serious offences."
