These legal actions stem from a recent escalation in federal immigration enforcement operations, which have led to thousands of arrests. Legal expert Elie Honig asserts that these lawsuits are "close to completely meritless," arguing there is no legal precedent for states or cities to prohibit federal agents from enforcing federal law. Honig explains that the Supremacy Clause and Article Two of the Constitution grant the federal executive branch the power to enforce federal law, and that any attempt to block this would likely be reversed on appeal. While judges may hold hearings to examine ICE's tactics, Honig believes a ruling prohibiting ICE enforcement is highly improbable.
